In the 24-second clip, Angilau is seen suddenly standing up at the defendant table, grabbing a pen or pencil near him and running toward the witness stand, where another member of the gang was testifying.

"Angilau was in custody, but he essentially had escaped custodial control for those seconds during which he was executing his plan to assault the witness", the judge added.

The witness, who was another gang member, managed to avoid Angilau's attack by moving to the corner of the courtroom and was unharmed.

A USA federal judge released footage of the 2014 fatal shooting of a gang member inside a courtroom Monday, showing the defendant rushing a witness with a pen before officers shot him.

'His attack was stopped by the shots that Jane Doe rapidly fired, in less than one and one-half seconds'.

However Angilau's family believes a jury should see the video to decide if the marshal used appropriate force, their lawyer Robert Sykes told Deseret News. He also noted that the defendant was already on the ground when the Marshall fired the final three shots, CBS News also reported.

'There was no necessity to use force'. Someone in the background yells, "woah, woah, woah", as Angilau deftly leaps onto the witness stand with his right arm poised to stop the state's testimony forever.

An investigation launched into the incident found the officer, who was not named, was legally justified in using the force he did.

Magistrate Judge Paul Cleary ordered the release of a pixelated version of the video obscuring faces of law enforcement officers and others in November, but the Department of Justice objected.

Stemming from a 2014 racketeering trial in Salt Lake City, the video was released after multiple media organizations filed records requests and tangled with government attorneys over issues over the years.

As US District Judge Tena Campbell was escorted out of the courtroom, someone called 911 at the end of the released video.
