Cosby prosecutor fights release of juror names

One more time, the lanky former jock with the loose-limbed gait and the mound of curly hair is likely to sit across a courtroom from the lumbering and aging comedian who has made an elegant wooden cane his signature prop on the most unsafe stage of his storied career.

Andrea Constand expressed gratitude to her supporters after a Pennsylvania judge declared a mistrial in the sexual assault trial stemming from her allegations against Bill Cosby.

It would be reasonable, based on the evidence presented, for the jurors to agree that Cosby is a sexual predator and still disagree on a verdict as to the assault of Constand.

As one of the jurors in the first trial said during jury selection in this case so bereft of physical evidence, the saga boils down to a matter of "he said, she said".

"They came here and deliberated long and hard over days, 52 hours of deliberations".

Cosby's camp has said he turned down a plea deal that would have spared him jail time, but District Attorney Kevin Steele's spokeswoman, Kate Delano, said Monday: "We never offered him a plea deal".

Agrusa revealed that she has an inkling of what might have taken place among the jury, though. McAndrews suggested that a jury pool could be drawn from the Harrisburg area of Dauphin County, or from the Scranton area of Lackawanna County.

The jury deadlocked at the end of the two-week trial, resulting in a mistrial Saturday.

Bill Cosby exits the Montgomery County Courthouse after a mistrial was declared in Norristown, Pa., Saturday, June 17, 2017. Meanwhile, O'Neill made it a point to say that a mistrial does not absolve Cosby from the charges.

Steele, the lead prosecutor, tends to be cautious in his public statements.

Levenson believes the breakdown of the first Cosby jury is important to know, but perhaps not predictive of how the second trial might go. We are confident in the case that we put on. "The retrial happens next, and the prosecution may try to call other accusers". After Casey Anthony was acquitted of suffocating her 2-year-old daughter in 2011, one juror quit her job and moved due to death threats she received, Hannaford-Agor said. "They want the element of surprise".

The alternates were told not to discuss the case because if one or more members on the main jury had to drop out for whatever reason, deliberations would start all over again with alternates joining the panel.

The AP does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done. Authorities reopened her complaint in 2015 after learning Cosby had testified in her lawsuit to giving various women wine, pills or even quaaludes before sex.

Cosby's accuser Andrea Constant leaves the courtroom at the Montgomery County Courthouse after a mistrial the Bill Cosby sexual assault case in Norristown, Pa., Saturday, June 17, 2017. There were a total of 12 trial witnesses.

An alternate juror in the Bill Cosby sexual assault trial told a Pittsburgh radio station he probably would have voted to convict the former comedian and TV star.
