Justice Karnan, on run, moves Supreme Court for relief

Calcutta High Court judge Justice Karnan has gone into hiding after facing arrest when the Supreme Court sentenced him to six months in jail.

The recall application, filed by counsel Nishchal Kumar Neeraj, argued that Justice Karnan had been sentenced in absentia on the basis of suo motu contempt proceedings initiated against him by the top court.

Calcutta High Court Judge Justice CS Karnan on Friday again mentioned his plea for early hearing before the five-judge Constitution Bench which was hearing the Triple Talaq case.

On Thursday, Karnan's lawyer had told the Supreme Court that the judge was "very much in Chennai" after a police team deployed to arrest him was not able to find him, PTI reported.

Chief Justice of India Jagdish Singh Khehar said that the top court will consider Justice Karnan's prayer seeking recall of the verdict against him.

The CJI made the remarks while he was sitting with four other judges who were hearing the issue of triple talaq. Go and give it (original copy of petition) to the registry.

"...the entire proceeding at the hands of the CJI in constituting the seven-judge bench finally culminating in his conviction and sentence, as aforesaid, is without jurisdiction", it said. You are not accepting any one-off procedure. You are one counsel who believes you can simply foist your stick here to get a hearing. The West Bengal police is yet to arrest the judge.

The search is continuing with the assistance of local police to comply with a Supreme Court order which sentenced the judge to six months imprisonment for contempt.

The apex court said in its order that High Courts, any tribunal and authority would not take any cognizance on the orders passed by Justice Karnan. He was due to retire next month.
